Cambodia allows foreigners to legally own condos under the 2009 Strata Title Law.

Yes. Foreigners may purchase 100% of condominium units and other strata-titled properties outright . These are true freehold titles above ground-floor level. You go through the land department registration like any local buyer. (The only restriction is land: foreigners cannot own ground-floor lots, but this is addressed via leasing or condo titles.)

Individual Foreigners (Strata Title Only)

Foreigners can legally own “Strata Title” properties (condos) from the first floor up. You do not need the mountain of paperwork that a local needs because you are not purchasing land.

  • Valid Passport

  • If buyer is married, then they need to present marriage certificate, passport of the spouse and name of the spouse’s parents

  • If buyer is not married, then they need to present a Certificate of Single Status issued either by their home country or their embassy in Cambodia, then have it translated into Khmer by a certified translation body in Cambodia.
  • Copy for witness valid ID or passport (individuals who will witness the sale)

Cambodian Locals (Hard or Soft Title)

For Khmer citizens, the documentation is much more rigorous because the law needs to establish whether the property is “Personal Property” (owned before marriage) or “Common Property” (owned jointly).

  • National ID Card: A certified copy.

  • Family Book or Residential Book: This proves your legal residence and lineage.

  • Marital Status Certificate:

             If Single: A “Single Certificate” from your local Sangkat/Commune.

             If Married: A Marriage Certificate. Both spouses usually must thumbprint the transfer unless one has a formal waiver.

  • Birth Certificate: Required to verify identity for the national land registry.

Land Holding Companies (LHC)

If a foreigner wants to buy land, a villa, or a ground-floor shop, they must use a company structure. This is a “Cambodian Company” where 51% is owned by a Khmer national and 49% is owned by the foreigner.

  • Certificate of Incorporation: From the Ministry of Commerce.

  • Articles of Association: Outlining the 51/49 split and decision-making rights.

  • 2026 Tax Patent: The updated annual business tax certificate.

  • VAT Certificate: To prove the company is active and compliant.

  • ID/Passports of Directors: Certified copies for all named board members.

Naturally, yes. Cambodia’s real estate sector stands out in its adoption of cryptocurrency, particularly in the capital, Phnom Penh. Here, off plan condos can be purchased from developers via trusted exchange providers in country using USDT, which is then converted to US dollars and transferred to the developer’s official bank account.

No. It is not required to hire a lawyer when dealing with a licensed and registered real estate agency. IPS is both licensed and registered as a real estate agency in Cambodia (License No. EV-12-096) and we have our own internal legal team that drafts all legal agreements for you without charge. In addition to this, our team is able to provide due diligence services to ensure your investment in property is without risk. 

 

Yes. Developers often offer flexible payment plans and may provide handover-stage loans for medium/long-term financing. IPS works with developers offering manageable payment plans and will provide detailed information on available plans to help you find the best fit for your financial strategy. Developer loans at handover may also be available, allowing for medium/long term manageability.  

No. You don’t need residency, a work permit, or a visa simply to invest. Cambodians welcome foreign buyers. Most visitors get visas on arrival, and if you plan to stay longer, the E-class visa is easy to get and renew (around $350/year).

A 4% title transfer tax at handover and a 0.1% annual property tax. Capital Gains Tax (20%) has been repeatedly postponed, including in 2026, but may apply depending on timing of resale.

An off-the-plan (off plan) property is a property that is purchased by the buyer prior to its construction being completed. However, buyers can view the unit layouts and construction plans, plus understand the precise inclusions of the Sales and Purchase Agreement (SPA) prior to purchasing. It’s also called pre-selling or a pre-sale property. It is also sometimes called an off-plan property.

The core benefit of buying off-plan is the opportunity to select condos or other units with the most-prime locations within the project, and there is also a chance to customize the condo to your unique needs in some cases. The price is also lower in the pre-sale phase, and customers benefit from staggered payment terms, normally including a booking fee, followed by payments according to the construction completion status of the project. This allows the buyer to pay overtime, and complete payments only when the unit is ready to handover. 

These fees typically range from $0.5 to $2 per square meter per month. The average is around $1 per square meter per month. Other associated costs may include utilities and parking charges if parking is required. Typical costs involved are around $0.25 per kwh for electricity, $0.60 per cubic meter for water, and car parking leasing charges for one vehicle are usually around $30-40 per month.

• Size: Larger properties are generally worth more than smaller properties.

Ownership is 100% transferable. Many investors lock in an exit: some projects (like ODOM) include guaranteed buyback options. Beyond that, IPS’s resale network (local & international) can help find buyers.

In order to sell a property in Cambodia, you will need the following documents:

If the seller is an individual –
✓ Proof of identification (Passport, National Identity Card, Cambodian ID card)
✓ Residential Book or Family Book
✓ Annual Property Tax Receipts
✓ Original Copy of Property Title
✓ Witness ID Card (individuals who will witness the sale)

If the seller is a company –
✓ Company’s Memorandum of Articles
✓ Company business licenses
✓ Tax Patent
✓ Power of Attorney for each company director
✓ ID card and birth certificate of Chairman of the board

All documents need to be certified by the ministry. Some certifications can be done in Phnom Penh or Siem Reap, and others can be done in your province of birth.

 

Cambodia has low transaction costs. The standard transfer tax on a first property sale is 4% of the property value (split between buyer/seller by custom).
